In order to receive Social Security benefits, you must prove you are disabled. The Social Security Administration (SSA) defines “disability” as being unable to work for at least 12 months due to one or more physical and/or mental problems. In making that determination, the SSA evaluates many factors, including your:

  • age
  • education level
  • past work experience
  • health problems

You should apply for all Social Security benefits as soon as you believe you are disabled. You do not have to be out of work for 12 months to apply. You can apply by either calling the SSA toll free at (800) 772-1213, going to your local district office, or online at www.SSA.gov. The amount of your potential benefit depends on which program you are eligible for, as well as other criteria.

You also may apply for Adult Disabled Medicaid at your county’s Department of Social Services. It is important to apply as soon as you think you are disabled to avoid the risk of losing any back benefits. Benefits for SSI can begin as early as the month after you first apply. Benefits for Disability Insurance are limited to one year prior to date of application.

Many people are denied on their initial application and on their first appeal. It is important to consult an attorney as soon as you receive your first denial as your appeal time is limited.
